Terms of service

The terms for using Showpiece, the Shopify app that turns a video of your product into a 3D model. Draft pending legal review.

These terms are an agreement between you and us, the operator of Showpiece (see our privacy policy for who we are). By installing or using Showpiece, you agree to them. If you use Showpiece for a business, you agree on behalf of that business.

What Showpiece does

Showpiece is a Shopify app. You film a product with your phone and upload the video. We turn it into a 3D model and suggested product photos. If you choose, the app adds them to your product in your Shopify store, where shoppers can view the 3D model and, on supported phones, place it in their room.

We may change or improve Showpiece over time. If a change takes away something important you rely on, we’ll tell you in advance where we reasonably can.

Who can use it

  • You need a Shopify store and must be allowed to install apps on it.
  • For now, Showpiece is available to stores based in the US and Canada.
  • You must be old enough to enter into a contract where you live, and you must use Showpiece for your business.
  • You’re responsible for your Shopify account and for anyone you let use Showpiece on your store.

Plans and billing

  • Showpiece has a free plan and paid monthly plans, described on our pricing section and in the app.
  • All charges are billed through Shopify, on your Shopify bill, under Shopify’s billing terms. We never see or store your payment details.
  • Paid plans include a number of 3D models each month. On a paid plan, extra 3D models beyond that are charged per model, up to a monthly limit you set in the app.
  • A 3D model counts toward your plan only when it’s finished and passes our quality check. Re-shoots we ask for don’t count.
  • If we change our prices, we’ll tell you in advance, before the new prices apply to you.

Your content

You’re responsible for the videos you upload and the products you film. By uploading a video, you confirm that:

  • you own the product or have the right to film it and sell it;
  • you have the right to upload the video, and it doesn’t infringe anyone else’s rights, such as copyright, trademarks or design rights;
  • it shows the product, not people or private information, as far as you can reasonably avoid it;
  • it isn’t illegal, harmful, offensive, or for a product you’re not allowed to sell.

We may refuse to process, or remove, content that breaks these rules.

Our permission to process your videos

You keep all rights in your videos. You give us a limited, non-exclusive, worldwide, royalty-free permission to store, copy and process your videos, and the 3D models and photos made from them, only to:

  • provide Showpiece to you, including making, storing, showing and publishing your 3D models and photos;
  • check quality and fix problems;
  • improve how well Showpiece works.

This permission ends when your data is deleted, as described in our privacy policy. We won’t sell your videos or show them to anyone outside the service providers we need to run Showpiece.

Who owns the 3D models

As between you and us, you own the 3D models and suggested photos made from your videos. You can use them on your store and anywhere else you like, including after you stop using Showpiece. Showpiece itself, including the app, our methods and our website, stays ours.

Acceptable use

Don’t:

  • try to break, overload, reverse-engineer or get around the limits of Showpiece;
  • use Showpiece to make 3D models of things you don’t have the right to show;
  • resell or share access to Showpiece outside your own store;
  • use Showpiece in a way that breaks the law or Shopify’s terms.

Availability and no warranty

We work hard to keep Showpiece running and to make great 3D models, but we can’t promise it will always be available, error-free, or that every video will produce a usable 3D model. Some products, such as shiny, see-through or very large ones, don’t work well. Timings, such as how long a 3D model takes, are estimates.

Showpiece is provided “as is” and “as available”. To the extent the law allows, we make no other promises or warranties, express or implied, including that it’s fit for a particular purpose.

Whether a 3D model appears on your product page, and how “view in your space” works, also depends on your Shopify theme, Shopify and shoppers’ phones, which we don’t control.

Limits on our liability

To the extent the law allows:

  • we aren’t liable for indirect or consequential losses, such as lost profits, lost sales or lost data;
  • our total liability to you for any claim about Showpiece is limited to the amount you paid us for Showpiece in the 12 months before the claim.

Nothing in these terms limits liability that can’t be limited by law.

Ending the agreement

  • You can stop at any time by uninstalling Showpiece from your Shopify store. What happens to your data then is described in our privacy policy.
  • We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering Showpiece. Where we reasonably can, we’ll give you notice first.
  • 3D models and photos already added to your products stay in your Shopify store after you uninstall.

Changes to these terms

We may update these terms. We’ll post the new version here with a new “last updated” date and, for important changes, tell you in the app or by email before they apply. If you keep using Showpiece after a change applies, the new terms apply to you.
